It was a setback for both the companies. A court in
Seoul, South Korean clamped down on the sale of some products made by Apple Inc.
(NASDAQ:AAPL) and Samsung, sag that the companies had infringed on each other's
patents.
However the ruling was particularly disappointing for
Apple, with the court refusing to accept that Samsung had copied the designs of
its iPhones and iPads.
The court imposed a ban on the products which were
found to be infringing on patents and includes Apple's iPhone 3GS, iPhone 4,
iPad 1 and iPad 2 and Samsung’s Galaxy S2 and some other devices.

While denying that Samsung had copied the designs of
Apple's popular phone and tablet PC, it ruled that Apple had infringed on two
of Samsung's patents, including those of wireless technologies.
On the look and feel of the Samsung phones the court
said, "Based on the similarity in these features, it is not possible to
assert that the two designs are similar."
However the court said that the company had infringed
on one of Apple's patents related to the screen's bounce-back feature.
Recent releases such as the iPhone 4S, Galaxy S3 and
the iPad 3 were not included in the ban.
Court spokesman Kim Mun-sung said the court's ruling
was to take effect immediately, although companies often request that sanctions
be suspended while they evaluate their legal options.
Apple has to pay about $35 million in damages to
Samsung which in turn has to pay $22,000 to Apple.
While this is a temporary setback for both companies
in their global battle over patents that is being fought over four continents,
their real test will comes later on Friday where a jury is expected to deliver
a verdict in a high-profile patents trial case in San Jose, California.
